ข้อกำหนดและเงื่อนไขการใช้บริการ
บริษัท แอนีเว็ต จำกัด (บริษัท) เป็นเจ้าของและผู้ดูแลจัดการแอปพลิเคชัน AnyVet ซึ่งให้บริการผ่านทางเครือข่ายอินเทอร์เน็ตจากอุปกรณ์เทคโนโลยีในรูปแบบต่างๆข้อกำหนดและเงื่อนไขในการให้บริการต่อไปนี้เป็นข้อกำหนดและเงื่อนไขในการให้บริการต่างๆ ซึ่งจัดทำขึ้นโดยบริษัท กับ ผู้ใช้บริการแอปพลิเคชัน AnyVet รวมถึงผู้ใช้บริการที่ลงทะเบียนบัญชีสัตวแพทย์มีสิทธิ์ในการให้คำปรึกษาผ่านทางวิดิโอคอลหรือแชท โดยการให้คำปรึกษาดังกล่าวจะครอบคลุมการตอบคำถามและคำแนะนำเกี่ยวกับสุขภาพสัตว์เลี้ยง รวมถึงการแนะนำผลิตภัณฑ์ต่างๆ ที่มีการวางจำหน่ายบนแอปพลิเคชัน "AnyVet" แก่ลูกค้าหรือเจ้าของสัตว์เลี้ยงที่ลงทะเบียนใช้บริการแอปพลิเคชัน AnyVet ซึ่งต่อไปนี้จะเรียกว่า "ผู้ใช้บริการ"
ผู้ใช้บริการจะต้องตกลงยินยอมตามเงื่อนไขและข้อตกลงในการให้บริการตามข้อกำหนดนี้ ตลอดระยะเวลาการเข้าเยี่ยมชม และ/หรือใช้บริการ และ/หรือเป็นสมาชิกของ AnyVet รวมถึงรับทราบดีแล้วว่าแอปพลิเคชัน AnyVet เป็นเพียงผู้จัดทำเว็บไซต์เพื่อสนับสนุนกิจกรรมพาณิชย์อิเล็กทรอนิกส์ของสมาชิกเท่านั้นทางบริษัทมิได้เป็นผู้ขายสินค้า หรือผู้ดำเนินการใดๆ เกี่ยวกับการแสดงหรือสินค้าดังกล่าวแต่ประการใด
การที่ผู้ใช้บริการใช้แอปพลิเคชัน AnyVet หรือเข้าไปดูข้อมูลในหน้าใดๆ ของแอปพลิเคชัน AnyVet ถือว่าผู้ใช้บริการยอมรับข้อผูกพันทางกฎหมาย ที่ระบุไว้ในข้อกำหนดและเงื่อนไขการใช้บริการนี้
2.1) ข้อมูลทั้งหมดที่ผู้ใช้บริการส่งเข้าสู่แอปพลิเคชัน AnyVet หรือให้ไว้แก่บริษัทไม่ว่ารูปแบบหรือวิธีการใดๆ ผู้ใช้บริการรับรองว่าเป็นข้อมูลที่เป็นความจริง ถูกต้อง สมบูรณ์ บริษัทมีสิทธิที่จะตรวจสอบความถูกต้องแท้จริงของข้อมูลดังกล่าว ทั้งนี้หากพบหรือมีเหตุอันควรเชื่อได้ว่าผู้ใช้บริการปลอมแปลงหรือใช้ข้อมูลและ/หรือเอกสารอันเป็นเท็จ หรือใช้ข้อมูลของบุคคลอื่นใดไม่ว่าบุคคลนั้นจะยินยอมหรือไม่ ในการใช้บริการตามข้อตกลงนี้ บริษัทสงวนสิทธิ์ในการระงับหรือยกเลิกการให้บริการไม่ว่าทั้งหมดหรือบางส่วนได้ทันที
2.2) ผู้ใช้บริการยินยอมให้บริษัทติดต่อสอบถามหรือเปิดเผยรายละเอียดหรือข้อมูลบางประการหรือทั้งหมด เกี่ยวกับผู้ใช้บริการที่บริษัทรับทราบมาเนื่องจากการใช้บริการใดๆ ของผู้ใช้บริการกับบริษัท กับบุคคล และ/หรือนิติบุคคลใดๆ เช่น การให้บริการ, การตลาด, การปรับปรุงระบบ เป็นต้น ได้ตามความจำเป็นและเหมาะสมทั้งนี้ เป็นไปตามนโยบายความเป็นส่วนตัว และคำยินยอมของผู้ใช้บริการที่ให้ไว้กับบริษัท
2.3) แอปพลิเคชัน AnyVet อาจมีการเชื่อมโยงกับเว็บไซต์อื่นๆ ซึ่งอาจมีการนำเสนอเนื้อหา ข้อความ ข้อมูล สินค้า บริการที่มีการเปลี่ยนแปลงได้ตลอดเวลา ดังนั้น บริษัทจึงไม่รับผิดชอบในความเสียหายต่างๆ ที่อาจจะเกิดขึ้นทั้งทางตรงและทางอ้อมจากการเชื่อมโยงไปยังเว็บไซต์ผู้ให้บริการรายอื่นๆ
2.4) ผู้ใช้บริการตกลงจะไม่เรียกร้องให้บริษัทรับผิดชอบต่อความเสียหายใดๆ ไม่ว่าทางตรงหรือทางอ้อม ที่เกิดจากความล่าช้าใดๆ หรือกรณีเกิดความขัดข้องทำให้ผู้ใช้บริการไม่สามารถเข้าใช้บริการแอปพลิเคชัน AnyVet ส่วนหนึ่งส่วนใด หรือทั้งหมด
2.5) บริษัทขอสงวนสิทธิ์ในการเปลี่ยนแปลงข้อกำหนดและเงื่อนไขการให้บริการนี้ในอนาคตไม่ว่าทั้งหมดหรือบางส่วนได้ตามความเหมาะสม รวมถึงการระงับการให้บริการส่วนหนึ่งส่วนใดของแอปพลิเคชัน AnyVet โดยมิต้องแจ้งให้ผู้ใช้บริการทราบล่วงหน้า
2.6) ในการใช้บริการแอปพลิเคชัน AnyVet ผู้ใช้บริการตกลงผูกพันและจะให้ความร่วมมือในการดำเนินการใดๆ เพื่อให้ถูกต้องเป็นไปตามหลักเกณฑ์และข้อกำหนดของกฎหมายที่เกี่ยวข้องกับบริการนี้ทุกประการ
3.1) ผู้ใช้บริการสามารถใช้บริการที่มีในแอปพลิเคชัน AnyVet ได้ โดยต้องอยู่ภายใต้ข้อกำหนดและเงื่อนไขที่กำหนดขึ้นระหว่างเจ้าของสินค้าและ/หรือบริการกับบริษัท
3.2) บริษัทมีสิทธิที่จะปฏิเสธไม่รับลงทะเบียนขอใช้บริการจากบุคคลใดๆ หรือจากผู้ใช้บริการ หรือไม่เปิดให้ใช้บริการต่างๆ ตามที่ผู้ให้บริการเห็นสมควร โดยไม่จำเป็นต้องแจ้งเหตุผลให้ทราบ
3.3) การกระทำการใดๆ โดยผ่านบริการไม่ว่ากรณีใดๆ ก็ตามหากกระทำโดยใช้รหัสผู้ใช้บริการและรหัสผ่านของผู้ใช้บริการ และ/หรือตรงตามวิธีการหรือเงื่อนไขที่บริษัทกำหนดไว้เกี่ยวกับการใช้บริการแอปพลิเคชัน AnyVet แล้ว ผู้ใช้บริการยอมให้ถือว่าการกระทำนั้นมีผลสมบูรณ์
3.4) ผู้ใช้บริการสามารถเปลี่ยนแปลงรหัสผ่าน (Password/PIN) ด้วยตนเองได้ตลอดระยะเวลาการใช้บริการโดยไม่ต้องแจ้งให้บริษัททราบ
3.5) รหัสผ่าน (Password/PIN) ถือเป็นความลับเฉพาะตัวของผู้ขอใช้บริการที่ต้องเก็บรักษาและปกปิดมิให้ผู้อื่นล่วงรู้
3.6) ในการใช้บริการผู้ใช้บริการจะต้องรับผิดชอบในการระบุหรือยืนยันข้อมูลต่างๆ เช่นเจ้าของสินค้าและหรือบริการ จำนวนเงิน และ/หรือรายละเอียดอื่นๆ เพื่อการใช้บริการด้วยตนเอง หากเกิดข้อผิดพลาดใดๆ ผู้ใช้บริการจะไม่เรียกร้องให้บริษัทต้องรับผิดชอบในความเสียหายใดๆ ทั้งสิ้น
3.7) ผู้ใช้บริการยินยอมชำระค่าธรรมเนียมค่าใช้บริการ และค่าใช้จ่ายใดๆ อันเกี่ยวเนื่องกับการใช้บริการให้แก่บริษัทตามเงื่อนไขที่บริษัทกำหนด
4.1) ผู้ใช้บริการที่แนะนำผลิตภัณฑ์ที่มีจำหน่ายบนแอปพลิเคชัน AnyVet จะได้รับสิทธิ์ในการสะสมคะแนนจากการแนะนำผลิตภัณฑ์เหล่านั้น ซึ่งคะแนนที่สะสมได้จะสามารถนำมาแลกเป็นสิทธิพิเศษต่างๆ ตามที่บริษัทได้กำหนดและประกาศไว้ในระยะเวลาและเงื่อนไขที่บริษัทกำหนดเพิ่มเติม
4.2) ผู้ใช้บริการต้องดำเนินการเข้าสู่ระบบผ่านบัญชีผู้ใช้งานของตนเองทุกครั้งก่อนที่จะทำการให้บริการหรือร่วมกิจกรรมต่างๆ ที่เกี่ยวข้องกับการใช้บริการบนแอปพลิเคชัน AnyVet
4.3) ผู้ใช้บริการตกลงและยินยอมที่จะรับผิดชอบต่อการกระทำต่างๆ ที่เกิดขึ้นทั้งหมดผ่านทางบัญชีผู้ใช้งานของตนเอง
5.1) ผู้ใช้บริการจะต้องดำเนินการแชร์ลิงก์หรือสินค้าผลิตภัณฑ์ต่างๆ ที่มีจำหน่ายบนแอปพลิเคชัน AnyVet ให้แก่ผู้ใช้บริการในระหว่างการให้คำปรึกษาผ่านทางแชทภายในแอปพลิเคชัน AnyVet เท่านั้น
5.2) ผู้ใช้บริการจะต้องทำการเข้าสู่ระบบบัญชีสัตวแพทย์ในแอปพลิเคชัน AnyVet ทุกครั้งก่อนที่จะทำการให้บริการหรือร่วมกิจกรรมต่างๆ ที่เกี่ยวข้องกับการแชร์ลิงก์ผลิตภัณฑ์และการสะสมคะแนน
5.3) การใช้คะแนนสะสมที่ได้จากการแนะนำผลิตภัณฑ์และการทำกิจกรรมดังกล่าวสามารถนำมาแลกเป็นของรางวัลและสิทธิพิเศษต่างๆ
เงื่อนไขของสมาชิกแอปพลิเคชัน AnyVet ต่อไปนี้จะเรียกว่า "เงื่อนไขการใช้บริการ" เป็นข้อตกลงระหว่างบริษัท แอนีเว็ต จํากัด ซึ่งต่อไปนี้ จะเรียกว่า "บริษัท" ฝ่ายหนึ่ง กับผู้ใช้บริการซึ่งลงทะเบียนสมัครสมาชิกแอปพลิเคชัน AnyVet กับบริษัท ซึ่งต่อไปนี้จะเรียกว่า "สมาชิก" อีกฝ่ายหนึ่ง เพื่อใช้บริการต่างๆ ของบริษัทที่กำหนดให้เป็นสมาชิก และมีการลงทะเบียน (Log in) เข้าระบบเพื่อใช้บริการและรับสิทธิประโยชน์อื่นใดที่บริษัทจะมอบให้แก่สมาชิก (เงื่อนไขเป็นไปตามประเภทบริการต่างๆ ของบริษัท และ/หรือรายการสิทธิประโยชน์ของบริการแต่ละประเภทที่บริษัทกำหนด และ/หรือนโยบายทางการตลาดของบริษัท) โดยเงื่อนไขการเป็นสมาชิกของบริษัทอาจมีลักษณะกระทบสิทธิ์ของสมาชิก ซึ่งสมาชิกควรอ่านและทําความเข้าใจอย่างละเอียด อนึ่งบริษัทในฐานะผู้จัดทำแอปพลิเคชัน AnyVet ขอสงวนสิทธิ์ในการเปลี่ยนแปลงเงื่อนไขต่างๆ รวมถึงการระงับการให้บริการส่วนหนึ่งส่วนใดของเว็บไซต์โดยมิต้องแจ้งให้สมาชิกทราบล่วงหน้า
"สมาชิก" หมายความว่า สมาชิกแอปพลิเคชัน AnyVet
"ข้อมูลส่วนบุคคล" หมายความว่า ข้อมูลเกี่ยวกับบุคคลซึ่งทำให้สามารถระบุตัวบุคคลนั้นได้ไม่ว่าทางตรงหรือทางอ้อม
2.1) วัตถุประสงค์ในการจัดเก็บข้อมูลส่วนบุคคลของสมาชิก : บริษัทเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของสมาชิกเท่าที่จำเป็น เพื่อใช้ประโยชน์ในการให้บริการแก่สมาชิก ซึ่งรวมถึง การระบุตัวตนของสมาชิก การดำเนินการตามคำขอใช้บริการของสมาชิก การชำระเงิน การส่งมอบสินค้าหรือบริการ การส่งข้อมูลยืนยันการทำรายการ การแก้ไขข้อร้องเรียนหรือแก้ไขปัญหาการใช้บริการให้กับสมาชิก การให้สิทธิประโยชน์สำหรับสมาชิก การพัฒนาคุณภาพของสินค้าและบริการ การจัดทำการตลาดเกี่ยวกับสินค้าและบริการ การจัดกิจกรรมส่งเสริมการขาย การทำวิจัย วิเคราะห์และสำรวจทางการตลาด การจัดทำข้อมูลสถิติ การนำเสนอสินค้าหรือบริการใหม่ให้แก่สมาชิกรายบุคคล สอบถามความคิดเห็นของผู้ใช้บริการ และ จัดทำสื่อประชาสัมพันธ์ให้แก่คู่ค้าของบริษัท รวมทั้งเป็นการปฏิบัติตามหน้าที่ที่กฎหมายต่างๆ กำหนดไว้
2.2) ฐานในการประมวลผลข้อมูล บริษัทดำเนินการประมวลผลข้อมูลส่วนบุคคลของสมาชิกภายใต้ฐานการประมวลผล ดังต่อไปนี้
3.1) เมื่อผู้ใช้งานทำการสมัครสมาชิกแอปพลิเคชัน "AnyVet" โดยการกรอกข้อมูลและลงทะเบียนครบถ้วนตามขั้นตอนที่บริษัทกำหนด บริษัทจะถือว่าผู้ใช้งานได้ตกลงและยอมรับข้อกำหนดและเงื่อนไขการใช้บริการทั้งหมดที่บริษัทระบุไว้
3.2) บริษัทขอสงวนสิทธิ์ในการเปิดการลงทะเบียนบัญชีสัตวแพทย์ของแอปพลิเคชัน "AnyVet" ให้เฉพาะผู้ใช้งานที่ได้ทำการสมัครสมาชิกและได้รับการยืนยันจากระบบของบริษัทเท่านั้น
3.3) สมาชิกตกลงและยอมรับว่าในการกรอกข้อมูลที่บริษัทได้ร้องขอในแอปพลิเคชัน "AnyVet" จะต้องเป็นข้อมูลที่เป็นจริงและเป็นปัจจุบัน
3.4) บริษัทขอสงวนสิทธิ์ในการพิจารณาการสมัครสมาชิก และมีสิทธิ์ที่จะปฏิเสธหรือยกเลิกการสมัครสมาชิกได้ตามดุลยพินิจของบริษัท
3.5) เงื่อนไขในการใช้บริการต่างๆ ของบริษัทในนามของสมาชิกจะถูกกำหนดเป็นรายบริการตามประเภทของบริการที่สมาชิกเลือกใช้
4.1) การเก็บรวบรวม สมาชิกตกลงยินยอมให้บริษัทสามารถเข้าถึง เก็บรวบรวม และใช้ข้อมูลส่วนบุคคลของสมาชิก ซึ่งได้ให้ไว้กับบริษัท และ/หรือที่บริษัทเก็บรวบรวมจากแหล่งอื่นหรือบุคคลอื่นใดโดยถูกต้องตามกฎหมาย
4.2) การเปิดเผยข้อมูลส่วนบุคคล สมาชิกตกลงและยอมรับว่าบริษัทอาจทำการเปิดเผยหรือส่งข้อมูลส่วนบุคคล ให้แก่บริษัทคู่ค้า ผู้ว่าจ้าง หรือร้านค้าที่เกี่ยวข้องกับการทำธุรกรรมของสมาชิกผ่านบริการของบริษัท
4.3) ระยะเวลาในการเก็บและใช้ข้อมูลส่วนบุคคล สมาชิกตกลงและยินยอมให้บริษัท ใช้ข้อมูลส่วนบุคคลได้ตลอดระยะเวลาที่ยังเป็นสมาชิก และให้ทำลายหรือดำเนินการให้ข้อมูลส่วนบุคคลดังกล่าวไม่เป็นข้อมูลส่วนบุคคลอีกต่อไปภายในกำหนดเวลา 90 วัน นับแต่วันที่ความเป็นสมาชิกสิ้นสุดลง
4.4) สิทธิของเจ้าของข้อมูลส่วนบุคคล สมาชิกมีสิทธิขอดูและรับสำเนาข้อมูลส่วนบุคคลที่บริษัทได้เก็บรวบรวม ใช้ เปิดเผย มีสิทธิขอให้ลบหรือทำลายข้อมูล ระงับ หรือทำให้ข้อมูลไม่สามารถระบุตัวตนได้ มีสิทธิขอแก้ไขข้อมูลส่วนบุคคลของสมาชิกให้ถูกต้องเป็นปัจจุบันสมบูรณ์ได้
4.5) ผลกระทบจากการไม่ให้ข้อมูลส่วนบุคคล สมาชิกทราบว่าการไม่ให้ข้อมูลส่วนบุคคลดังกล่าว จะทำให้ไม่สามารถเป็นสมาชิก แอปพลิเคชัน AnyVet ได้ แต่ยังสามารถใช้บริการอื่นๆ ของบริษัทที่ไม่ต้องสมัครสมาชิกได้ตามปกติ
5.1) บุคคลที่จะทำการสมัครเป็นสมาชิก AnyVet ได้ต้องเป็นบุคคลธรรมดามีอายุตั้งแต่ 20 ปีบริบูรณ์ ขึ้นไป หรือบรรลุนิติภาวะโดยทำการสมรสถูกต้องตามกฎหมายแล้ว
5.2) สมาชิกยืนยันว่าข้อมูลส่วนบุคคลที่ใช้ในการสมัครสมาชิกเป็นข้อมูลส่วนบุคคลของสมาชิกเอง และได้ทำการสมัครสมาชิก AnyVet ด้วยตนเอง
5.3) ข้อมูลส่วนบุคคลของสมาชิกที่ใช้ในการสมัครสมาชิกเป็นข้อมูลส่วนบุคคลที่ถูกต้องเป็นความจริงและเป็นปัจจุบัน
5.4) หากบริษัทพบว่าสมาชิกมีคุณสมบัติไม่ตรงตามที่บริษัทกำหนดไว้ บริษัทมีสิทธิยกเลิกความเป็นสมาชิกดังกล่าวและสงวนสิทธิ์ในการให้สิทธิประโยชน์ใดๆ ที่สมาชิกได้รับจากการเป็นสมาชิกนั้น
6.1) สัญลักษณ์, ข้อความ, รูปภาพ, วิดีโอ และสื่อสารสนเทศน์ต่างๆ ที่อยู่ในแอปพลิเคชัน AnyVet ถือว่ารวมอยู่ในลิขสิทธิ์ของผู้ให้บริการ หรือบริษัท แอนีเว็ต จำกัด
6.2) ข้อกำหนด เงื่อนไขและข้อห้ามที่เกี่ยวข้องกับลิขสิทธิ์ในทรัพย์สินทางปัญญาที่ทางบริษัทระบุและกำหนดไว้ให้ผู้ใช้บริการปฏิบัติตาม
6.3) ห้ามมิให้ผู้ใดทำซ้ำ, ดัดแปลง, ดาวน์โหลด, ลอกเลียนแบบ, จัดจำหน่าย, เผยแพร่ต่อสาธารณชน, อัพโหลด ส่วนหนึ่งส่วนใดของเนื้อหา, สัญลักษณ์, เครื่องหมายการค้า, ข้อความ, รูปภาพ, วิดีโอ และสื่อสารสนเทศน์ต่างๆ บนแอปพลิเคชัน AnyVet
6.4) ข้อกำหนดและเงื่อนไขฉบับนี้ให้ใช้ภาษาไทยเป็นภาษาที่ใช้บังคับ การแปลความหมาย การตีความ ความสมบูรณ์ และการปฏิบัติตามข้อกำหนดและเงื่อนไขฉบับนี้ ให้เป็นไปตามที่กำหนดไว้ภายใต้บังคับของกฎหมายไทย และให้ศาลไทยเป็นศาลที่มีอำนาจในการพิจารณาคดี
กรณีที่มีข้อโต้แย้งเกี่ยวกับสิทธิประโยชน์จากการเป็นสมาชิก สมาชิกตกลงและยอมรับให้บริษัทมีอำนาจในการตรวจสอบและปรับปรุงสิทธิประโยชน์ให้กับสมาชิก และการตัดสินของบริษัทถือเป็นที่สุด
กรณีพบว่ามีการฉ้อฉล ปลอมแปลง หรือการกระทำทุจริตใดๆ เพื่อให้ได้มาซึ่งสิทธิประโยชน์ เพื่อแลกรับของพรีเมียม และ/หรือส่วนลด และ/หรือ สินค้า และ/หรือบริการต่างๆ ไม่ว่าจะเป็นเพียงบางส่วนหรือทั้งหมด หรือที่ยินยอมให้ผู้อื่นกระทำการข้างต้น สมาชิกตกลงและยอมรับว่า บริษัทมีสิทธิ์ปฏิเสธการโอนสิทธิประโยชน์ของสมาชิก
9.1) สมาชิกตกลงและยอมรับผูกพันตามข้อกำหนดและเงื่อนไขของการเป็นสมาชิกที่บริษัทกำหนดไว้ขณะที่แจ้งขอสมัครสมาชิก และรวมถึงการเปลี่ยนแปลงแก้ไขที่อาจมีขึ้นในภายหน้า โดยบริษัทมิต้องแจ้งให้ทราบล่วงหน้า
9.2) สมาชิกตกลงและยอมรับว่า บริษัทมีสิทธิในการเปลี่ยนแปลงเงื่อนไขของสมาชิก การแลกของพรีเมียม และสิทธิประโยชน์ สิทธิพิเศษต่างๆ โดยมิต้องแจ้งให้สมาชิกทราบล่วงหน้า กรณีที่มีปัญหาขัดแย้ง คำชี้ขาดของบริษัทถือเป็นที่สิ้นสุด
สมาชิกตกลงและยอมรับว่า บริษัทมีสิทธิปฏิเสธการสมัครนี้ หรือสามารถยกเลิกสมาชิกได้ โดยไม่จำเป็นต้องระบุสาเหตุการปฏิเสธ/ยกเลิกดังกล่าว หากสมาชิกมีความประสงค์ยกเลิกการเป็นสมาชิก สามารถแจ้งยกเลิกได้ที่ โทร. 065 939 5785
สมาชิกตกลงและยอมรับว่า:
11.1) บริษัทต้องใช้เวลาในการดำเนินการยกเลิกความเป็นสมาชิกเป็นเวลา 30 วันนับแต่วันที่สมาชิกได้ร้องขอ อันเนื่องมาจากกระบวนการในการลบหรือทำลายข้อมูล หรือการทำให้ข้อมูลส่วนบุคคลไม่เป็นข้อมูลส่วนบุคคลอีกต่อไป ต้องบอกกล่าวไปยังผู้มีส่วนเกี่ยวข้องให้ดำเนินการด้วย ทั้งนี้ บริษัทอาจใช้เวลามากกว่า 30 วัน หากข้อมูลส่วนบุคคลมีปริมาณมากและซับซ้อน

AnyVet Co., Ltd. (the "Company") is the owner and administrator of the AnyVet application, which provides services via the internet network through various technological devices. The following terms and conditions for service constitute an agreement between the Company and the AnyVet application service user, including service users registered as Veterinarian Accounts who have the right to provide consultation via video call or chat. Such consultation covers answering questions and providing advice regarding pet health, including recommending various products available on the "AnyVet" application to customers or pet owners registered to use the AnyVet application, hereinafter referred to as the "Service User."
The Service User must agree to the terms and conditions of service herein throughout the duration of their visit, use of service, and/or membership of AnyVet. The Service User acknowledges that the AnyVet application is merely a website developer intended to support the e-commerce activities of members only. The Company is not a seller of goods or an operator regarding the display or such goods in any way.
By using the AnyVet application or viewing any information on any page of the AnyVet application, the Service User is deemed to have accepted the legal obligations specified in these Terms of Service.
2.1) The Service User warrants that all information submitted to the AnyVet application or provided to the Company in any form or method is true, correct, and complete. The Company has the right to verify the authenticity of such information. If it is found or there is reasonable cause to believe that the Service User has forged or used false information and/or documents, or used another person's information whether with or without that person's consent to use the service under this agreement, the Company reserves the right to suspend or cancel the service immediately, in whole or in part.
2.2) The Service User consents to the Company contacting, inquiring, or disclosing certain or all details or information regarding the Service User that the Company has obtained through the Service User's use of services, to persons and/or any juristic persons (e.g., for service provision, marketing, system improvement, etc.) as necessary and appropriate, in accordance with the Privacy Policy and the consent provided by the Service User to the Company.
2.3) The AnyVet application may contain links to other websites, which may present content, messages, information, goods, or services that change at any time. Therefore, the Company is not responsible for any damages, whether direct or indirect, arising from linking to other service providers' websites.
2.4) The Service User agrees not to demand the Company to be responsible for any damages, whether direct or indirect, caused by any delay or failure that prevents the Service User from accessing the AnyVet application, in whole or in part.
2.5) The Company reserves the right to change these Terms of Service in the future, in whole or in part, as appropriate, including suspending any part of the AnyVet application service without prior notice to the Service User.
2.6) In using the AnyVet application, the Service User agrees to be bound by and cooperate in any actions to ensure compliance with the criteria and requirements of laws related to this service in all respects.
3.1) The Service User may use the services available on the AnyVet application subject to the terms and conditions established between the product owner and/or service provider and the Company.
3.2) The Company has the right to refuse registration for service from any person or Service User, or not to open various services for use as the service provider deems appropriate, without the need to provide a reason.
3.3) Any action performed through the service in any case, if performed using the Service User's ID and Password and/or in accordance with the methods or conditions specified by the Company regarding the use of the AnyVet application, the Service User agrees to deem such action as valid and complete.
3.4) The Service User can change the Password/PIN by themselves throughout the service period without notifying the Company.
3.5) The Password/PIN is considered a specific secret of the applicant which must be maintained and concealed from others.
3.6) In using the service, the Service User shall be responsible for specifying or confirming various information, such as the product owner and/or service, amount, and/or other details for service usage by themselves. If any error occurs, the Service User shall not demand the Company to be responsible for any damages.
3.7) The Service User agrees to pay service fees and any expenses related to the use of service to the Company according to the conditions determined by the Company.
4.1) Service Users who recommend products available on the AnyVet application will have the right to accumulate points from recommending those products. Accumulated points can be redeemed for various privileges as determined and announced by the Company within the periods and conditions additionally specified by the Company.
4.2) Service Users must log in via their own user account every time before providing services or participating in various activities related to service usage on the AnyVet application.
4.3) The Service User agrees and consents to be responsible for all actions occurring through their own user account.
5.1) Service Users must proceed to share links or products available on the AnyVet application to Service Users during consultation via chat within the AnyVet application only.
5.2) Service Users must log in to the Veterinarian Account in the AnyVet application every time before providing services or participating in various activities related to sharing product links and accumulating points.
5.3) The use of accumulated points obtained from product recommendations and such activities can be redeemed for rewards and various privileges.
The following conditions for members of the AnyVet application, hereinafter referred to as the "Terms of Service," constitute an agreement between AnyVet Co., Ltd., hereinafter referred to as the "Company," on one part, and the service user who registers for AnyVet application membership with the Company, hereinafter referred to as the "Member," on the other part. This agreement is for the use of various Company services designated for members, where logging in is required to access services and receive any other privileges the Company may grant to the Member (conditions vary according to the Company's service types and/or the list of privileges for each service type determined by the Company and/or the Company's marketing policies). As the conditions of membership may affect the Member's rights, the Member should read and understand them in detail. Furthermore, the Company, as the developer of the AnyVet application, reserves the right to change various conditions, including suspending any part of the service, without prior notice to the Member.
"Member" means a member of the AnyVet application.
"Personal Data" means information relating to a person which enables the identification of such person, whether directly or indirectly.
2.1) Objectives for collecting Member's Personal Data: The Company collects, uses, or discloses the Member's Personal Data as necessary to provide services to the Member. This includes verifying the Member's identity, processing service requests, payments, delivering goods or services, sending transaction confirmations, resolving complaints or service issues, providing member privileges, improving the quality of goods and services, conducting marketing for goods and services, organizing promotional activities, conducting research, market analysis and surveys, compiling statistical data, presenting new products or services to individual Members, inquiring about user opinions, and creating public relations materials for the Company's business partners, as well as complying with duties prescribed by various laws.
2.2) Basis for Data Processing: The Company processes the Member's Personal Data under the following bases:
3.1) When a user applies for membership on the "AnyVet" application by filling out information and completing the registration according to the steps determined by the Company, the Company shall deem that the user has agreed to and accepted all Terms of Service specified by the Company.
3.2) The Company reserves the right to open the registration of Veterinarian Accounts on the "AnyVet" application only to users who have applied for membership and have been verified by the Company's system.
3.3) The Member agrees and accepts that the information filled in response to the Company's request in the "AnyVet" application must be true and current.
3.4) The Company reserves the right to consider membership applications and has the right to refuse or cancel membership at the Company's sole discretion.
3.5) Conditions for using various Company services on behalf of the Member will be determined per service according to the type of service the Member chooses to use.
4.1) Collection: The Member agrees and consents to the Company accessing, collecting, and using the Member's Personal Data provided to the Company and/or collected by the Company from other sources or any other person lawfully under the laws enforced at that time.
4.2) Disclosure of Personal Data: The Member agrees and accepts that the Company may disclose or send Personal Data to business partners, contractors, or shops related to the Member's transactions through the Company's services.
4.3) Retention Period: The Member agrees and consents to the Company using Personal Data throughout the period of membership and to destroy or anonymize such Personal Data within 90 days from the date membership ends.
4.4) Rights of the Data Subject: The Member has the right to request to view and receive a copy of the Personal Data collected, used, and disclosed by the Company. The Member has the right to request deletion, destruction, suspension, or anonymization of the data. The Member has the right to request correction of Personal Data to be correct, current, and complete.
4.5) Impact of Non-Provision of Personal Data: The Member acknowledges that failure to provide such Personal Data will result in the inability to be a Member of the AnyVet application, but the user can still use other Company services that do not require membership as usual.
5.1) A person applying for AnyVet membership must be a natural person aged 20 years or older, or have reached legal age by marriage according to the law.
5.2) The Member confirms that the Personal Data used for membership application is the Member's own Personal Data and that they have applied for AnyVet membership by themselves.
5.3) The Member's Personal Data used for membership application is correct, true, and current.
5.4) If the Company discovers that the Member does not meet the qualifications specified by the Company, the Company has the right to cancel such membership and reserves the right regarding any privileges the Member received from that membership.
6.1) Symbols, text, images, videos, and various information media contained in the AnyVet application are considered to be included in the copyright of the service provider or AnyVet Co., Ltd.
6.2) Terms, conditions, and prohibitions related to intellectual property rights specified and determined by the Company must be observed by the service user.
6.3) No person shall reproduce, modify, download, imitate, distribute, publicize, or upload any part of the content, symbols, trademarks, text, images, videos, and various information media on the AnyVet application.
6.4) These Terms and Conditions shall use the Thai language as the governing language. Translation, interpretation, completeness, and compliance with these Terms and Conditions shall be in accordance with the provisions of Thai law, and Thai courts shall have jurisdiction to adjudicate cases.
In the event of a dispute regarding membership privileges, the Member agrees and accepts that the Company has the authority to verify and adjust privileges for the Member, and the Company's decision is deemed final.
In the case where fraud, forgery, or any corrupt acts are found to obtain privileges, to redeem premiums and/or discounts, and/or various goods and/or services, whether in part or in whole, or where the Member consents to others doing the aforementioned, the Member agrees and accepts that the Company has the right to refuse the transfer of Member privileges.
9.1) The Member agrees and accepts to be bound by the Terms and Conditions of membership determined by the Company at the time of application, including changes and amendments that may occur in the future, without the Company needing to give prior notice.
9.2) The Member agrees and accepts that the Company has the right to change membership conditions, premium redemption, and various privileges and special rights without prior notice to the Member. In case of conflicting issues, the Company's ruling is deemed final.
The Member agrees and accepts that the Company has the right to refuse this application or cancel the membership without needing to specify the reason for such refusal/cancellation. If the Member wishes to cancel membership, they can notify cancellation at Tel. 065 939 5785.
The Member agrees and accepts that:
11.1) The Company requires time to process the membership cancellation for 30 days from the date the Member requested, due to the process of deleting or destroying data or anonymizing Personal Data. Relevant parties must also be notified to proceed. However, the Company may take more than 30 days if the Personal Data is voluminous and complex.
11.2) The requester will not be able to re-apply for membership within 180 days or until the Company considers otherwise.
The Member agrees to be responsible for damages and to protect the Company, executives, employees, agents, and related persons arising from the Member's use of services on the website and violation of these Terms and Conditions of service. The Member cannot raise any legal grounds to claim damages and/or any indemnity from the Company, executives, employees, agents, and related persons.
These Terms and Conditions shall use the Thai language as the governing language. Translation, interpretation, completeness, and compliance with these Terms and Conditions shall be in accordance with the provisions of Thai law, and Thai courts shall have jurisdiction to adjudicate cases.
